SMS & Email Marketing Consent Policy

This Consent Policy details how Ellie's communicates with you via email and text message (SMS) for marketing, dining updates, and transactional alerts, in compliance with the Telephone Consumer Protection Act (TCPA) and California's Anti-Spam Act (Business and Professions Code Section 17529.5).
1. Email Marketing Communications
By subscribing to our newsletter, completing a contact form, or opting in during your reservation or ordering process, you consent to receive periodic promotional emails from Ellie's.
- These emails contain information on seasonal menus, chef collaborations, Monday Supper events, and restaurant news.
- Opting Out: You may opt-out of receiving marketing emails at any time by clicking the "Unsubscribe" link located at the bottom of any email communication. Opt-out requests are processed immediately.
2. SMS (Text Message) Communications
By providing your mobile telephone number and explicitly checking the opt-in box during the booking or checkout process, you agree to receive automated transactional and marketing text messages from Ellie's.
- Transactional Texts: These include reservation confirmations, booking changes, waitlist notifications, and order pickup alerts.
- Marketing Texts: These include occasional announcements about events, promotions, and dining specials.
- Consent Conditions: Opting in to receive text messages is not a condition of purchasing any goods or booking a standard dining reservation.
3. SMS Program Rules & Opt-Out
- Message and Data Rates: Standard carrier messaging and data rates may apply depending on your mobile plan.
- Message Frequency: The frequency of marketing SMS messages varies but will not exceed 4 messages per month. Transactional text frequencies depend on your active reservations/orders.
- How to Opt-Out: You can unsubscribe from text messages at any time by replying STOP to any message you receive from us. After replying STOP, you will receive one final confirmation message.

4. Data Security & Third-Party Platforms
We utilize trusted reservation and messaging providers (such as Resy and ToastTab) to transmit automated text messages. We do not sell, rent, or lease your phone number to third parties for their independent marketing purposes.
